Beware of companies who claim to prevent foreclosure on your home

 Beware of companies who claim to prevent foreclosure on your home as many of these companies are not legitimate. Before you pay any up front fees or sign any documents I would recommend that you first contact your mortgage servicing company and or lender. Many mortgage serving companies are willing to work  with you to save your home. It is very important that you stay in communication with your lender when you are having trouble making your mortgage payments so they may offer you options for a possible work out plan or loan modification.

There are companies out there who prey on homeowners who are facing hard times and feel as if they are stuck between a rock and a hard place and have nowhere to turn. These companies will ask you to pay them up from fees and get you to sign an agreement for them to work on a loan modification for you. Many of these companies are showing up as scams and taking peoples money and loosing their homes.  Many homeowners are willing to listen to these people as they seem to listen and care for your needs.

Today I received a call from a homeowner who was under the impression that National Financial Solutions, LLC was working for him to get a loan modification on his home. This evening a man came to his door to advise him that he had just purchased his home at the court house steps this morning at the Foreclosure Sale. Of course this homeowner had believed that this company was working to save his home and was caught of guard as he is no longer the home owner. He has lost his home to Foreclosure while he awaited a loan modification on his home. He had not spoken to his lender in months while working with this other company who claimed they would save his home.

I have never heard of this company so I did a Google search and was amazed at the information that was found on this company. They were listed on the www.RipOffReport.com and www.Scam.com along with other sites. Seems as if some employees have also posted complaints with the company as well. Some times options for a work out program or loan modification plans many not work. Don't just walk away from your home as there There are other options to Foreclosure. There are some legit companies out there who will work with you and your mortgage servicer and or lender. I have done work for one of these companies since 2007 that has actually helped homeowners to save their homes. The primary role of this company is to get the homeowner back in communication with the mortgage servicer or lender and see what options are available to help you stay in your home.

Your moving company brought who with them ?

Moving Truck - Photo by Roland WoodworthToday I received a call from a fellow Realtor who is also a Army wife doing a PCS move to Fort Lewis, WA. When the movers showed up at her door this morning there were a total of 6. Now this could be a good thing if they were all workers.. right ?

I was stunned to hear that they brought along 2 children and a puppy.... What did you say ?

Yes.. I said this correctly. I was stunned that they would even allow this to happen. To top it off, the puppy did what all puppies seen to do..... Yes the puppie did his business on the floors.

This makes me wonder who these moving companies are hiring to assist our military families with their moves. I recently assisted another friend get his househould goods packed and shipped. This was featured in another post.  Do you really know who is packing up your home ?

This brings me to my next question... Does the transportation office here at Fort Campbell, KY know who they are contracting to pack and transport household goods of our men and women that serve our country ? Of course you are going to get the Good, the Bad and the Ugly when you are contracting mass movements. I just wonder how often these things get reported.

What do you really know about this house?

Sure, it looks like a bargain from the outside. The media makes these foreclosed homes sound like the ultimate deal.

There is no seller's disclosure to tell you about any problems or repairs that have been made from the previous owners.

What you don't know may kill you and ruin you financially!

Many of these foreclosed homes may have had meth labs in them. Just walking in one can be dangerous! Realtors really have no idea they might be touring a future health issue.

Read here about one family's discovery and illnesses from a home they purchased. They did not discover the meth history for 5 years after they moved in. They were all sick and now broke! More about meth homes.

Once foreclosed, they are resold without any documentation of the history. Just walking in one of these homes is dangerous.

What if one was bought to flip and only minimal cosmetic work was done and it was back on the market to unsuspecting buyers?

Many clients ask me about foreclosures. I don't have any listed and I don't usually show them to clients. I might show one if it is listed or the client requests it specifically.

In Kentucky it is now a Class D felony to rent, lease or sell a home if the owner has not provided a written notice that the property has been contaminated by methamphetamine and has not been properly cleaned up by a certified contractor.

Each violation could result in a fine of up to $25,000 and/or imprisonment from one to five years.   

Mold can be another issue in foreclosed homes. I can remember standing outside one home while the client looked inside. All of the basement walls had black mold! I had toured this one before it went into foreclosure and ran across this. I told the client before we went and they still wanted to tour it. They didn't buy it. I knew they wouldn't before going over there.

There are even more hidden issues in these foreclosed homes. Liens, water damage and more! I want the best for my clients and no legal issues for later down the road for both of us.

Be aware before you buy. What smells like a bargain may be no bargain in the long run.

Don’t Wait-Only 138 Days to Claim Your Share of the Tax Credit

Don't Wait To Start Your House HuntThe rush is on.  The deadline for purchasing a home using the $8000 tax credit is November 30, 2009.   You might be surprised to find out how quickly the remaining days left to take advantage of the "free" money from the government will click away.

Let's take a look at how you might use up your time remaining.

Before you even head out the door to look at houses you need to have made contact with a lender and start the pre-approval process.  The further you get along in this process before you get in a car to look at a home the better.  For timing we will say that this process will take you a week because you are super organized and have all of the documents on hand that your lender needs.  (7 Days Gone)

Now you are ready to actually head out and look.  With lower inventory (below $250,000) than a year ago, it would be realistic to think that it will take you 30 days to find a house.   Then there is the contract ratification process.  If you are lucky and you have focused on seller owned properties you may be able to get a ratified within 7 days.  (37 Days Gone)

With the new appraisal rules (HVCC) and the new lender rules (HERA) going into effect you can expect that getting your final loan approval will be 30-45 days.  For our calendar we will take the longest number just to be safe. (45 days Gone).



How are we doing so far?  Looks like we have knocked 89 days off the calendar leaving 49 days left until the deadline.  Whew looks like you have plenty of time to get this done.

Wait we forgot to add in the days that FHA is going to require for a second appraisal (it is happening more and more) or the processing time at the settlement company.  So let's pad those 89 days with an extra 7 to be on the safe side.  Now we have taken a total 96 days off the calendar.  Leaving you 42 days to move in and enjoy your new home. 

If you take longer to find a home, if the lender takes longer to approve your loan or you think you want to buy a short sale....then you may have waited to long!

Are you still thinking about whether the market might decline a bit more making your dream home just a bit more affordable?  Or are you waiting for the interest rates to come down to 4.5% again?   If you are then every day you wait is one less day that you have to deal with any issues in your schedule.  If you are serious about buying a new home this year and are eligible for the $8000 tax credit then time is of the essence.  Don't sit on the fence much longer or you may find yourself looking at the calendar on December 1st and wondering what you were waiting for.
